Symphony Environmental Technologies PLC (AIM: SYM) said its writ against the European Commission, Parliament, and Council of the European Union was heard on 20 March 2023.
The biodegradable plastics group has sued the EU over Article 5 of the Single-use plastics Directive 2019/904, which it says is unlawful, claiming losses and reputational damage.
In summary, Symphony does not accept that Article 5 applies to its technology. Still, the confusion caused worldwide by the legislation's wording obstructs its adoption.
“For every day it remains in force, Symphony suffers a loss, but more important, ordinary plastic continues to be used, and thousands of tons of it are getting into the open environment,” the company added.
A written judgment will be delivered in due course, Symphony noted, though this will be without warning, with its legal advisers estimating a ruling could take 12 to 15 months.
